Max Nogay focuses his practice on complex criminal and civil litigation at the state and federal levels. He is a former federal prosecutor and an experienced civil and criminal litigator. As an Assistant United States Attorney, Max regularly represented federal agencies and employees and prosecuted cases involving fraud by federal funding recipients, leading to the recovery of millions of dollars for the United States.
During his tenure with the U.S. Department of Justice, Max acquired expertise in various areas, including the False Claims Act, the Federal Tort Claims Act, the Americans with Disabilities Act, the Fair Housing Act, and the Clean Water Act. He regularly led investigations of qui tam actions and successfully defended whistleblower lawsuits filed against federal agencies.
With significant appellate experience, Max has argued on multiple occasions before the United States Court of Appeals for the Fourth Circuit and represented federal regulatory agencies, including the Securities and Exchange Commission and the Federal Energy Regulatory Commission.
Max also served as the Civil Rights Coordinator for the U.S. Attorney’s Office and regularly presented and offered seminars on civil rights topics. He was recognized for his civil rights work, receiving a commendation from the Associate Attorney General for the U. S. Department of Justice’s Civil Rights Division.
Before serving as a federal prosecutor, Max practiced at a West Virginia based firm, where he focused on complex civil and criminal litigation in state and federal courts.
Max is a proud Mountaineer, having attended West Virginia University as an undergraduate and law student. He was a standout in the classroom, graduating with honors each time, and on the diamond, where he was the catcher for the WVU baseball team.
